Divorce

Going through a divorce can be extremely challenging, and you shouldn’t have to go through it alone.  With deep roots in the local community, both of our attorneys understand the intricacies of the court system in Northeast Wisconsin. Every case is unique, and we are dedicated to providing the time and attention you need.

Whether your divorce is amicable and relatively straightforward or highly contested and emotionally charged, we are here to advocate for your rights and interests with compassion and dedication.  At M&M Law, LLP, we handle all aspects of divorce, including custody and placement arrangements, child support, property division, maintenance, and any other issues that may arise.

  • Child Custody/Placement. Custody and placement of your children can be one of the most difficult issues to face during a divorce.  If parents cannot agree on their own, the first step is typically to go to mediation through your county’s Family Court Program.  If mediation is unsuccessful or inappropriate for your case, the court may appoint a Guardian ad Litem, who is an attorney appointed to represent the children’s best interests.  No matter how your case progresses, we have the knowledge and experience to guide you through the process.
  • Child Support.  In Wisconsin, child support calculations are primarily determined by a statutory formula outlined in the state’s child support guidelines. These guidelines consider various factors (such as the placement arrangement, the parents’ incomes, and the number of children) to ensure that child support payments are fair and consistent across different cases.
  • Property Division.  Generally, courts in Wisconsin presume that all property should be equally divided between the spouses.  There are exceptions to this presumption, notably gifted/inherited property will generally remain with the party who received it.  The court will also consider other circumstances to reach a fair division, such as the length of the marriage and the property brought to the marriage by each spouse.
  • Maintenance (Spousal Support/Alimony). Maintenance refers to the financial support that one spouse may be required to pay to the other during or after divorce proceedings. This support is intended to address disparities in income and earning potential between spouses, ensuring that both parties can maintain a reasonable standard of living post-divorce.  Courts consider many factors when determining whether maintenance is appropriate, most notably the length of the marriage.

If you and your spouse agree on most issues independently, we can help facilitate a fast and fair resolution, guiding you through the process with efficiency and ease. On the other hand, if your divorce involves high conflict and contentious disputes, rest assured that our team is well-equipped to handle even the most challenging situations, advocating for your best interests every step of the way.

Our goal is to make the divorce process as stress-free as possible for our clients, providing the support and guidance you need to navigate this difficult time with confidence. Whether through negotiation, mediation, or litigation, we will work to achieve the best possible outcome.
